Terms and Conditions
1. The Promotion is run by National Basketball League (ABN 65 164 187 937) of Level 6,10 Queens Road, Melbourne VIC 3004 (Promoter). The Promoter has the permission of Chemist Warehouse Pty Ltd (ABN 57 629 683 530) to promote their business in this competition (Business).
2. Information on how to enter, and the prize details, form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. If an entrant is under 18 years of age when entering the Promotion, their parent or guardian must also read, understood and agree to these Terms and such entrant’s participation in the Promotion.
3. If you are an eligible person and satisfy all entry requirements as set out below, then subject to these Terms and Conditions, you will be entered into the competition draw to win a prize (Promotion). Entries into the Promotion open at 16th February at 10am and close at 24th February at 11.59pm (Promotional Period).
Entrant requirements
4. Entry to the Promotion is open to all Australian Residents who are at least sixteen (16) years old at the time of entry and have a valid email address, who comply with the ‘Entry’ provisions set out below. An ‘Australian Resident’ means a person who resides in Australia at the start of the Promotional Period and who holds Australian citizenship or holds an Australian permanent residency visa.
5. Employees, directors and officers, and their immediate family and respective household members, of:
a. the Promoter and the Business;
b. the related bodies corporate of the Promoter and the Business; and
c. any advertising or promotion agencies of the Promotor and the Business,
are not eligible to enter. ‘Immediate family’ means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.
6. Entry into the competition is free, subject to the entry requirements.
7. Entrants under 18 years old must have the consent of their parent or legal guardian to enter the Promotion and further, the entrant’s parent/guardian must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Promotion.
Entry into the Promotion
8. To enter the Promotion and be eligible for the Prize Draw, entrants must during the Promotion Period play the ‘Chemist Warehouse Hoop Heroes’ game at www.nbl.com.au/chemistwarehouse and enter the requested information including full name, mobile and email.
9. Entrants can only enter the Promotion once.
10. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render any entries submitted by that individual invalid.
11. Each entry must be made in accordance with these Terms and Conditions. By entering the Promotion, each entrant agrees to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions.
Prize Draw
12. The total retail value of the Promotion prize pool is AU$500 (excluding GST), as at February 2024.
13. There will be one (1) winner randomly selected who will receive $500 Chemist Warehouse gift voucher.
14. There will be one (1) draw conducted for the Promotion. The draw will be conducted via the Tradable Bits online platform on 25th February at 10am. Eligible entrants are not required to be present at the draw to win.
15. The Promoter may draw additional reserve entries and record them in case an invalid or ineligible entrant is drawn. Entries in each draw will not be entered into any subsequent draws.
16. Any expenses related to the prize, collecting the prize or enjoying the prize (including but not limited to flights, accommodation, meals etc) will be borne by the winners.
17. No component of the prize can be transferred or redeemed for cash or any other service provided by the Promoter. In the event that any of the prizes become unavailable, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions of a relevant regulatory authority.
18. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or suspend or modify a prize, subject to any requirements of a relevant regulatory authority.
19. Decisions of the Promoter are final and will be binding on each person who enters the Promotion, and no correspondence will be entered into.
Prize Awarding
20. The winner will be notified in writing by direct email message through the email supplied when entering the Promotion and their name published at www.nbl.com.au/competitions.
21. Winners must respond to the Promoter’s notification message and provide prize delivery details in order to claim their prize. Each prize must be claimed within 14 days after the relevant publication date. Any unclaimed prize will be forfeited by the winner.
22. If any winner does not satisfy these Terms and Conditions or cannot be contacted within a reasonable timeframe in accordance with all requirements of all regulatory authorities, the entry will be invalidated, and a further entry drawn on 11th March at the same place as the original draw in order to distribute the unclaimed prize. All non-winning entries from the original draw will be included in the unclaimed prize draw. Any winner of the unclaimed prize draw will be notified in writing (via the contact details supplied when entering the Promotion) and the winner’s name and state will be published on www.nbl.com.au/competitions. This will continue until a valid winning entry is drawn for each prize draw.
23. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
a. to disqualify any entrant; or
b. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
24. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct, calculated to jeopardise fair and proper conduct of the Promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
25. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. All taxes which may be payable as a consequence of receiving the prize are the sole responsibility of the winner. Any additional costs involved are at the winner’s expense. Independent financial advice should be sought.
26. If a prize is won by an eligible person who is under 18 years old, at the Promoter’s discretion:
a. the Promoter may require such winner to be accompanied by their parent or legal guardian throughout prize fulfilment; and
b. the Promoter will have the discretion of whether such prize will be awarded to that person or their parent/guardian on their behalf. The Promoter will advise the winner and their parent/guardian of this decision.
Exclusion of liability
27. To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether director consequential) to persons or property as a result of any person entering into the Promotion or accepting or using any prize.
28. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this competition, or for any technical error that may occur in the course of the administration of the Promotion.
29. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
Data collection and privacy
30. The Promoter and the Business collects personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to other third parties, including but not limited to, agents, contractors, service providers and prize suppliers as required in Australia. Entry is conditional on providing this PI. The Promoter and Business will also use, and handle PI as set out in NBL’s Privacy Policy available at http://www.nbl.com.au/privacy-policy/ and Business’ Privacy Policy available at https://www.chemistwarehouse.com.au/aboutus/privacy.
31. In addition to any use that may be outlined in the Privacy Policies identified above, the Promoter and Business may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policies also contain information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter and the Business. The Promoter and the Business may disclose entrant's PI to any entity outside of Australia in accordance with their respective Privacy Policies.
General
32. Entrants agree that they are fully responsible for any materials or responses they submit via the Promotion including but not limited to comments, recordings and images (Content). The Promoter or the Business shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever.
33. As a condition of entering the Promotion, each entrant licenses and grants the Promoter, the Business and the Promoter and Business’ affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
34. Entrants consent to the Promoter and the Business using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for a reasonable period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or the Business in connection with the Promotion.
35. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
36. Except or any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
a. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b. any theft, unauthorised access or third-party interference;
c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d. any variation in prize value to that stated in these Terms and Conditions;
e. any tax liability incurred by a winner or entrant; or
f. taking of the prize/attendance at the prize event.
37. The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Melbourne, Victoria Australia.

The NBL is required to comply with the Privacy Act 1988 (Cth) and is bound by the Australian Privacy Principles (‘APPs’) set out in that Act. CAN YOU DEAL WITH THE NBL WITHOUT IDENTIFYING YOURSELF?
In some limited situations fans, members and other individuals may be able to deal with NBL anonymously or using a pseudonym. For example, if you make a general inquiry to one of our call centres, or want to make a complaint unless the inquiry or complaint relates to a particular account. However, if you do not wish to be identified we may not be able to provide the information or assistance you require.
However, to gain access to the benefits of Bounce Pass, you will need to create a Bounce Pass account.
WHAT PERSONAL INFORMATION DOES THE NBL USUALLY COLLECT?
The NBL collects a wide range of personal information about its customers, but the type and amount of information collected depends on the particular business context. However, the NBL seeks at all times to ensure that it only collects the personal information that is necessary for the purposes of its business activities. The NBL needs to collect basic identifying and contact information for trade promotion entrants, all fans and members including prospective fans and members. This will usually include first name, last name, date of birth, address (postal and email), contact details, geographic location (including your country, suburb and postcode), gender and transaction details relating to your use, enquiry or purchase of our products or services (or of those promoted by us) and any preferences you tell us about. From time to time, the NBL may require proof of identity information, including passport number, driver licence number or other government identifiers.
NBL also collects information about purchasing patterns, consumer preferences and attitudes from prospective and current fans and members for marketing and promotional purposes, including to analyse markets, develop marketing strategies and to identify and develop products and services that may be of interest to its customers.

COLLECTION FROM THIRD PARTIES
The NBL may collect personal information regarding a child from the parent or legal guardian of that child.
In some circumstances, NBL collects information from other third parties including, but not limited to, its clubs and ticketing partners. Our third party service providers may also collect anonymous usage data on the terms of their privacy policies. This anonymous usage data may be used to identify your device on third party digital services where we have an arrangement in place to serve ads on those third party digital services. We may also collect anonymous usage data from third party digital services.
INFORMATION STORAGE AND PROTECTION
We understand that the security of your personal information is important. The NBL stores information in different ways, including in paper and electronic form. We take all reasonable steps to protect your personal information (and your anonymous usage data) and to keep it secure from loss, unauthorised access, modification, disclosure, interference or other misuse and we have appropriate controls in place to limit who in the NBL can view, access and/or use your personal information and anonymous usage data. NBL uses includes strict confidentiality requirements of our employees, volunteers, service providers, security measures for system access and security measures for our website.
Much of the information we collect from and about our members and from or about people who register their interest in the NBL is added to one of NBL’s databases. When your information is entered into NBL’s membership database, the information may be combined or linked with other information held about you.

Websites linked to the NBL website are not subject to NBL’s privacy standards, policies or procedures. NBL cannot take any responsibility for the collection, use, disclosure or security of any personal information that you provide to a third party website.
IS PERSONAL INFORMATION DISCLOSED OUTSIDE AUSTRALIA?
The NBL discloses some personal information to persons or organisations that are outside Australia.
NBL’s customer service and marketing call centre operations are based in Manila, Philippines. Personal information about prospective, current and past fans, members and customers is accessed by our Manila based staff for the purpose of sales and marketing, customer service, correspondence, and other support activities.
Database and webhosting services provided to NBL involves personal information being transferred to IT service providers based in India, Philippines, Singapore, New Zealand, the United Kingdom, Canada and the United States of America.
HOW DOES NBL PROTECT YOUR PERSONAL INFORMATION?
The NBL recognises the importance of protecting your personal information and of ensuring that it is complete, accurate, up-to-date and relevant. NBL will take all reasonable steps to ensure that the personal information it collects, uses or discloses is accurate, complete and up-to-date. However, we rely on the accuracy of personal information as provided to us both directly and indirectly.
Our staff are trained to properly handle the different types of information they receive, particularly sensitive information. We have quality assurance measures in place to monitor calls to ensure that our processes are being followed. While some of the personal information we collect is held in hardcopy form, most personal information is stored in electronic databases. We have extensive processes in place to ensure that our information systems and files are kept secure from unauthorised access and interference.

We encourage you to regularly review and update your personal information. You can access your personal information in your Bounce Pass account section. Otherwise, if you would like to access the personal information that we hold about you, please let us know by making a request via the contact details set out below. We will respond to your request for access within a reasonable period. If you find that the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will correct it. You can delete your Bounce Pass account in the account section after logging in.
RESOLVING PRIVACY ISSUES AND COMPLAINTS
Any issues or complaints in relation to the collection, use, disclosure, quality, security of and access to your personal information may be made to the NBL in one of the following ways:

This Privacy Policy describes the practices and processes NBL has in place to properly manage and safeguard that information.

The NBL is required to comply with the Privacy Act 1988 (Cth) and is bound by the Australian Privacy Principles (‘APPs’) set out in that Act. The APPs establish minimum standards for the collection, use, disclosure and handling of personal information. They apply to personal information in any form, including electronic and digital form. The NBL collects personal information about you in order to personalise your experience on the NBL digital platforms (which includes Bounce Pass, NBL1, 3x3Hustle, Dream Courts and the NBL and NBL1 mobile applications),process your registration, entry into trade promotions, competitions and other offers from the NBL, its related companies, its partner or sponsors and to carry out its functions, including to provide you with requested products and services, personalised news, video content, special offers and other information as well as to facilitate the provisions of marketing and promotional services that may be of interest to you and for the purposes otherwise set out in our Privacy Policy.
NBL uses personal information only for the purposes for which it was provided and for directly related purposes (unless you have provided your consent for us to use it for another purpose or otherwise required by or authorised under law). In some limited situations fans, members and other individuals may be able to deal with NBL anonymously or using a pseudonym. For example, if you make a general inquiry to one of our call centres, or want to make a complaint unless the inquiry or complaint relates to a particular account. However, if you do not wish to be identified we may not be able to provide the information or assistance you require.
However, to gain access to the benefits of Bounce Pass, you will need to create a Bounce Pass account.
WHAT PERSONAL INFORMATION DOES THE NBL USUALLY COLLECT?
The NBL collects a wide range of personal information about its customers, but the type and amount of information collected depends on the particular business context. However, the NBL seeks at all times to ensure that it only collects the personal information that is necessary for the purposes of its business activities. The NBL needs to collect basic identifying and contact information for trade promotion entrants, all fans and members including prospective fans and members. This will usually include first name, last name, date of birth, address (postal and email), contact details, geographic location (including your country, suburb and postcode), gender and transaction details relating to your use, enquiry or purchase of our products or services (or of those promoted by us) and any preferences you tell us about. From time to time, the NBL may require proof of identity information, including passport number, driver licence number or other government identifiers.
NBL also collects information about purchasing patterns, consumer preferences and attitudes from prospective and current fans and members for marketing and promotional purposes, including to analyse markets, develop marketing strategies and to identify and develop products and services that may be of interest to its customers.

COLLECTION FROM THIRD PARTIES
The NBL may collect personal information regarding a child from the parent or legal guardian of that child.
In some circumstances, NBL collects information from other third parties including, but not limited to, its clubs and ticketing partners. Our third party service providers may also collect anonymous usage data on the terms of their privacy policies. This anonymous usage data may be used to identify your device on third party digital services where we have an arrangement in place to serve ads on those third party digital services. IS PERSONAL INFORMATION DISCLOSED OUTSIDE AUSTRALIA?
The NBL discloses some personal information to persons or organisations that are outside Australia.
NBL’s customer service and marketing call centre operations are based in Manila, Philippines. Personal information about prospective, current and past fans, members and customers is accessed by our Manila based staff for the purpose of sales and marketing, customer service, correspondence, and other support activities.
Database and webhosting services provided to NBL involves personal information being transferred to IT service providers based in India, Philippines, Singapore, New Zealand, the United Kingdom, Canada and the United States of America.
HOW DOES NBL PROTECT YOUR PERSONAL INFORMATION?
The NBL recognises the importance of protecting your personal information and of ensuring that it is complete, accurate, up-to-date and relevant. NBL will take all reasonable steps to ensure that the personal information it collects, uses or discloses is accurate, complete and up-to-date. Our staff are trained to properly handle the different types of information they receive, particularly sensitive information. We will respond to your request for access within a reasonable period. If you find that the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will correct it. You can delete your Bounce Pass account in the account section after logging in.
